How you handle these issues goes to the core character of the nation. Shooting 'intruders' is perhaps one way of looking at it. A few 'simple' cases of water-boarding people thought will not have any repercussions. How wrong those people were. Similarly, police torturing 'intruders' and defending such actions does not make it right. It just erodes the basic character of the entire country. Would you want to teach your own kids as to how to treat such issues ? Shooting, shackling, water-boarding etc ? I see that the above discussion keeps on going on about EB-2 only. Doesn't anyone at IV care about EB-3 I also . I am sure there are a few EB-3 I people at IV who are suffering from retrogression , myself included.

Senthil has articulated legal basis of current system. However, many members feel agrieved by current situation. My displeasure with current law was based on my perception about principles of natural justice and a dogma that one measure (current provisions) should not negatively impact others basic rights for happiness, equality, nondiscrimination etc. Courts could take a look at how much damege or injury is possible or actually already resulting (stalled careers, family separation, life on hold, creativity-innovation halted) in current system. Atleast it will open up healthy debate and rational measures to address genuine problems.
Could anybody clarify as to whether counting of family members towards annual quota is mandated by congress or it is an administrative provision.

I had the exact same question. If one responds to an RFE on his/her I-485 app, is there no place on the online status description where we can find the original receipt date?
Also, can one assume that his/her case has is pre-adjudicated, if there are no further requests from USCIS after an RFE reponse from the applicant?

he is just expressing concern that more action is not taken. i wrote param a pm to explain, also this thread will not continue indefinitely. we do however need to be clear in our stand and in our actions. we should be able to enunciate what we believe without resorting to the kind of vitriol that is thrown at us. personally i am waiting to see that- it's important even to grow as a community and achieve success that we develop this ability. our strength lies in the facts not in any hate or rhetoric.

Yes everything is personal when you are so close to the effort. The answer is still the same for anyone that did not participate and find out for themselves what it takes to co-ordinate an event like this.

Just ignore the accusations. Two things here. Firstly, people are really frustrated here with all the GC stuff. Secondly, there has been lot of Anti-immigrants coming in and trying to disrupt the forums, making people inherently suspicious.

That does not mean that IV favors or is concerned about EB2 only.
What is IV ? - it is us ... the members .....
There may be more EB2 related posts and predictions / estimates than EB3 because,
1. The EB2 numbers are a little easier to estimate ....
2. Maybe members affected by EB3 retrogression are not posting many predictions / estimates, as it seems like a hopelessly long wait....
3. There are a few members here that are making their plight seem worse by posting, wild guesses or guesstimates that are gloomy (such as 50k EB2 IN each in 2004 and 2005) ........
4. No one has yet posted a good estimate (not a guess or guesstimate) of the EB3 backlog....
5. It takes a lot of time and patience to dig for reliable data......

Well, one does not know the exact pre-adjudication policy at the service centers i.e do they re-open a pre-adjudicated file after a certain time period or something in the several database changes that prompts it.
One thing we need to remember and is certain is that, in the month of June and July 2nd of 2007, just before the fiasco thousands of GC's were issued (much much beyond the capacities of all I-485 service centers). This happened only because of pre-adjudication. I know several who had gotten RFE's in the year before and simply got their GC's quickly in June and July 2nd. (with EB3-I PD 03/04/05 as well !)
One thing we need to remember and is certain is that, in the month of June and July 2nd of 2007, just before the fiasco thousands of GC's were issued (much much beyond the capacities of all I-485 service centers). I was asking a question as to what should be done to people who already got their GC thru Labor Sub, since someone said that all the subs of 2007 should get the I-140 filing date as the priority date. I care only about the present and future. This is what I meant when I asked the question.
