    Can we propose a bill which would give us - the honest, sincere, law abiding aliens - a time bound path to Green Card and Citizenship?

    Political parties only talk and seem to be interested in giving illegals a time bound path to citizenship? They even introduced a "Dream Act" in favour their children. Why should we / our children be sidelined?

    Can we request for a bill which would:

    1.Grant GC to all EB 2 / 3 class pimary applicants who have completed 8 years of continuous stay in the USA without any criminal record.

    2. Provide Citizeship to all EB primary applicants who have completed 12 years of continuous stay without any criminal record

    Note:

    When the primary applicant is issued a GC / Citizenship, the dependents (spouse and kids) should get the same benefit.

    The current system is designed to favour ONLY the employers and the law firms, not the humble, hard working EB class slave who toils.

    I never expected that you will be kind enough to reproduce my text verbatim from my posting in the "Predictions Part II" thread"

    Here is what I want to add:

    1. Time bound path simplifies several redundant and "non-value add' activities

    2. The alien immigrant starts investing within the USA, plans to buy a home etc as he is sure that he will become a respectable citizen in 12 years

    3. This system is followed in several EU countries and UK and even Australia and Singapore. This is not ssomething new. It is a time tested program

    4. It also helps the immigrant to decide his plan of action. For example, if he feels he cannot wait for 8 years, he has the option to plan his exit out of the USA (and go to his home country or whatever)

    5. The employers / lawyers cannot perpetually arm twist, harass and exploit the immigrant by blackmailing him with the threat of withdrawing the I 140, for example

    6. This guarantees individual liberty which is supposed to be "pillar stone" of the US Constitution

    From our side -

    1. It will forge unity (no more EB2 / EB3 fights)

    2. Encourage active participation by all EB friends

    So far -

    1. In terms of policy / rule the only fix that has happened in all these years seems to be AC21 (However, even with EAD it appears that shifting jobs is not easy! This has been discussed at length in the AC 21 thread)

    2. We have otherwise been able to achieve very minor admin fixes after years of toil

    3. Under the existing framework we will continue to be grouped with the illegals who will never allow us to come of this mess. They may be illegal, but have the lobby power, money powe, muscle power and vote power.

    4. CIR will never see the light of the day, because of political compulsions.

    5. Day in and day out we are trying for Visa recapture, but we have not succeeded because of the unfortunate inherent EB2 / EB3 split within our ranks (and others enjoy the fun and benefit from it)

    I feel that this approach will filter the legals from the illegals and a I hope that several right thinking law makers would support us.

    Lessons learned:
    (1) Keep Fedex delivery proof for receipt date in addition to I-485 notice
    (2) Keep the memo concerning July fiasco
    (3) Memo for AC 21 if it applies.

    I am surprised that the IO didn't have the memo for the July fiasco.

    What is even more frustrating is that we are chasing this so called American Dream during the most potent years of our lives and literally wasting our lives away.

    That's exactly it Ragz. That one statement summarized it all. The MOST potent and important years of our lives and our spouses lives are going Right down the drain. I feel even worse for the spouses. Atleast we HAVE jobs and our careers are going SOMEWHERE. The countless spouses on here and even more so not on here are suffering away today for a better tomorrow. It may just happen that when the Work permits/ GCs do come thru, our spouses' skills may be extinct due to having no work for so many months/years.

    This is definitely an angle to explore. As my spouse was telling me the other day. God Forbid, if this problem lasts for another year and then some of us decide to move back coz we are tired of this nonsense, our spouses will find it just as hard to find jobs in our home countries as well. Think about it, our home countries are pumping out fresh blood everyday. Will the companies select them, or someone who has been out of touch with the job scene for 1-2 (or many more) years?

    Here is the problem

    -- Grass root & state level efforts work only when there are a lot of grass root workers. For example independence struggle in india worked due to grass root efforts. But please try to understand that things are different here --- by definition, we are immigrants, our numbers are limited in this country.


    Okay. Its obvious that we need more participation from members for higher rate of success for IV campaigns.


    Simply put, groups working in isolated corners of the country are having no effect on the politicians, because each area has only a few people and the politicians are not seeing the combined effect.

    "Grass root efforts" may sound very trendy, but are actually leading us no where............yes we need it......but at the same time IV has to have a strong leadership who can show their strenght by doing phone / lettere campaigns.

    Actually I disagree with you on two fronts. Even with low member participation, whatever success IV had is to a large measure due to the member participation. Second point is your post seem to suggest, I might have misread your statement, that just the IV leadership alone can make the phone/letter campaign a success. How? I am not privy to IV core information but I would doubt that just the IV core calling and writing letters would persuade the folks in DC to change their position.

    My take is that the IV core can help come up with focused action items, and its by increasing grass roots effort that we can achieve the IV goals. IV core can also help with the lobbying activity, which again needs funds from the members. Increasing member participation in IV is the difficult part. Talk is easy.

    Is the writing still not clear on the wall. There is so much opposition here to our action against Eb3 -> Eb2 porting, from all this people who are in the process of porting.

    No, I didn't go out of the country for stamping, coz i was under the impression that my visa was Change of Status from L-1 to H-1. Only now, i could find from the immigration lawyer that i don't have a valid I-94. My employer was napping too, all this while.

    I'd like to take this opportunity to thank each one of you on the immigration voice core IV team for your dedication and perseverance and, congratulate all of us on this triumphant success with the USCIS decision in our favor. I very closely watched the immigration voice threads, especially, over the past week and don't think would have found a better blogspot for realtime updates and advice. Its been a tough time for most of us and that was sure evident with rising tempers on the forums and restlessness that was tangible. I think a celebration is in order. Cheers!!! ;)

    This is a good start but more work is needed. You need to highlight how arbitrarily NSC stopped approving after Aug 20. TSC still kept approving after that and even NSC issued an approval 2 days back. Clearly, the statements about visa un-availability and avaialbility have been inconsistent.

    Also, I think sending letter to Ombudsman is useless.

    We need to send to Zoe lofgren.

    Also, we need to highlight that only 15 days are left and action is needed within that time to issue more approvals.

    Please also highlight how NSC went on an ridiculous RFE issuing spree after complaint faxes were sent.

    We need to definitely start sending letters on monday. Otherwise, it will be too late.

    Folks,

    I edited the letter so please take a look at this version. Some of you'll have suggested I condense the letter to a series of questions alone - I think this is a good idea and will be more effective in capturing attention. I will prepare something in this format (but it will have to wait for the weekend).

    For now, my intent with this letter is to ask that the ARBITRARY nature of the visa bulletin be put to an end. I am exhausted by the cycle of raised and dashed hopes when the visa bulletin moves forward and backward.

    To those of you'll who brought up the issue of schisms between EB2 and EB3, please read paragraph two above. Let us correct this randomness before we tackle each of the issues that are making life so difficult for us. You could start by gathering your friends, co-workers and other EB3 applicants and put together your list of issues to be addressed along with solutions. My view is that if USCIS is incapable of taking care of the matter then we have to pitch in and suggest/prod/request/demand it of/from them.

    Together we can do it!

    September xx, 2008

    Sir/Madam,

    On behalf of the employment-based legal immigrant community in the United States of America, I am writing to highlight the ongoing egregious inefficiencies in the immigration �services� provided by the USCIS and the DOS. There have been numerous occasions when there have been erratic movements in the DOS published visa bulletin dates. This, as we understand it, is owing to USCIS under- or over-estimating the number of applicants available for adjustment of status. And in the rare instances when the date finally moves forward by a substantial window, USCIS tends to approve the more recent applications as opposed to the ones that were filed earlier. Let me explain with an example: in the July 2008 visa bulletin, the cut-off date for the India EB2 category was 01 April 2004. A month later, the cut-off date for Indian EB2 applicants abruptly moved forward two years and was set at 01 June 2006. Instead of approving applicants who applied in 2004 and 2005, USCIS approved applicants from 2006. Where is the justice in that??? Why bother publishing the cut-off date if approvals are to be randomly allocated???

    We understand we have to stand in line and wait our turn. Each applicant is assigned a priority date which chronologically determines his/her turn for approval. To further complicate matters, once the I-485 is filed, a crop of other dates are issued by the USCIS � a receipt date, a notice date and a processing date. USCIS then takes the liberty to throw random rules at us � �Case adjudication is based on receipt date� �No, we process applications based on notice date�, �Actually, it�s the processing date that determines which applications are adjusted.� !!!

    Please take a moment to consider how these conflicting statements and arbitrary decisions wreak havoc on our morale and psyches? No one, NOT even the USCIS, has a clue as to what exactly is happening in their processing centers. The USCIS has never been able to clearly state the exact number of applications languishing, excuse us, we meant pending, in their �service� centers! We, employment-based immigrants, are tax-paying, law-abiding, educated individuals contributing to America�s knowledge economy - yet we have been subjected to the worst aspects of the US employment-based immigration system. These include:

    1) Extended wait times at each step of the immigration process.
    2) Lack of transparency on the part of USCIS (re: priority date, receipt date, notice date).
    3) Lack of USCIS customer service � once applications are submitted to USCIS they disappear into a black hole. Barring a website where one nominally can check one�s case status (but which in reality remains static for months, even years!) there is no concept of updating an applicant on where his case stands. And this is despite the applicant paying immigration fees that often run into thousands of dollars over the years. We are simply expected to wait in a complete void of information, for however long it may take, until approval.
    4) Lost opportunities owing to the lack of job portability during the process (a time period spanning an average of five years, whereas an applicant from any country besides India gets his/her PR card in under two years).

    While we are grateful for the opportunity to partake in the American dream, it is ironic that we arrive in America and find that our freedom is shackled � we are bound to our sponsoring employer from the start to the end of the extremely lengthy process. Although legal immigration reform is our ongoing aim, for now, we sincerely request you to investigate the process whereby the monthly visa bulletin is set and to ensure FIFO (first in, first out) adjustment so that those of us who have been waiting longer receive attention prior to those who have applied later. We want USCIS to be accountable to us, its paying customers.

    We request you to lend us your ear and address these issues so that we are not subjected to them in the future.

    devang77 pretty much covered the experience of most participants !

    Let me add my observations here:
    For people who doubt where all the money is going, remember Aman founded this organization putting his own money into this ( not in hundreds but thousands). He and some other core members has already got their green cards, but they continue to work for this cause. I also remember Aman and core members saying this "It is not about you. It is about the community. You just don't think about yourself, you work for everyone." Most of the talk points for meetings were meant for relief to the entire community, not a specific group.

    For me, I had to go for a meeting alone. Initially I was disappointed, but I could handle that meeting very well, thanks to IVs training session. For those who are apprehensive about attending these meetings -- It is pretty straightforward if we follow IVs talking points and presentation style. We cover ourselves well with arguments and counter arguments during training session.

    As for meeting lawmakers, it will always be a pleasant experience. This is the greatest democracy on the face of the earth. Lawmakers will lend a patient, listening ears to your issues. No worries there. Also fixes to our issues will benefit not only us, it will help this country in the long run. If you haven't met your lawmaker yet, please plan meeting them and let them know your pains. A meeting from a constituent is very valuable for these lawmakers.

    A request to IV core:
    It is better if IV could conduct the training in different state chapters, so that people will feel more confident and less apprehensive in meeting their lawmakers.

    Kudos & thanks a lot IV team! I hope this inspires members to contribute regularly which in turn will enable the core team to carry on the sustained lobbying effort to bring about systemic changes. Although today's news is great, this is only a small step. Now begins the long long wait till our cases are taken up for adjudication. Our woes will not go away unless the underlying problem of severely constrained visa availability is addressed.
    Time to roll up our sleeves and continue working with renewed vigor.
